How to conclude a contract with us using this website
These are the steps you need to take to conclude a contract with us:
(1) Make sure you have read and understand our terms
It is your responsibility to read the legal terms on our website carefully and to raise any problems with us before you place your order. This includes these terms and conditions, our terms and use and our privacy policy.
(2) Browse our information
This website contains information about our goods which you will need to know before you place your order including descriptions of our goods, current prices (including delivery and returns policies.
The information about the goods on our website constitutes an "invitation to treat" and is not a contractual offer from us which you may accept. This means that we reserve the right to correct any errors in that information without liability to you. It also means that in no circumstances will we be contractually bound to supply you with goods on the basis of any incorrect information, even if that information is repeated in your order.
2.1 Labelling
Labelling i.e. Harris Tweed Labels are only shown for illustrative purposes, if you require the label to be stitched onto the cushion or footstool please inform us prior to purchase.
(3) Select the goods you wish to purchase
You can select any items you wish to purchase by clicking on the "add to basket" button. You will be taken to your shopping basket whenever you add a new item, but you can also view the contents of your shopping basket by clicking on the "shopping basket" button. The shopping basket screen lists your current selection of items with description, price and current subtotal. You can edit the contents of your basket and remove any input errors by removing items or changing quantities.
(4) Making a Purchase
To purchase the items in your basket and proceed with your order using our secure online purchasing facility, click on the "Checkout" button on the shopping basket screen. You will then be asked to enter your email address and password if you are an existing user of the site, or to register if you are a new user. You can then click for Decur Checkout where our secure server provider Paypal will process the payment for Visa, MasterCard, American Express or through Google Checkout to complete your order. You will also have the option to pay using a Cheque or Postal Order. You will be asked to provide certain information we need to enable us to process your order such as your preferred delivery address and payment details. It is your responsibility to provide us with sufficient information to process you order.
We will acknowledge receipt of your order by email. This is not our acceptance of your order, but confirmation that it has been received.

(5) Wait for acceptance of you order
You may not assume we have accepted your order until we send you an acceptance by email. Only if and when you receive our acceptance will we have a binding contract between us. You may receive acknowledgement from our payment processor advising you whether or not your credit or debit card payment has been authorised. This acknowledgement relates to your payment only and is not our acceptance of your order.
We will be entitled to refuse to accept your order if in our sole discretion we consider it necessary. In particular we must receive payment of the whole of the price for the goods that you order before your order can be accepted. If we refuse your order we will let you know as soon as we can. If we accept your order we will inform you without undue delay.
Once we have entered into a contract with you we shall supply you with the items specified in your order in accordance with the terms of the contract.
Other information about the Contract.
All payments are taken in full.
We can only conclude the contract with you in English and not in any other language.
The contract between us will consist of (1) these terms and conditions together with our terms of use and privacy policy, (2) your order and (3) our acceptance. We will not file the concluded contract between us online and you should therefore print out and retain copies of each element of the contract.
a. Price
The prices payable for goods that you order are set out in our website.
6 Cancellation Policy, Amendment of orders & Returns
6.1 ’No Quibble Returns’ policy and the Distance Selling Regulations apply to your order only if the goods have not been made bespoke, custom-made, made to measure, tailored to your specifications, clearly personalised, or examined by you in one of our shops. If applicable, you are entitled to cancel your order before delivery or within 14 working days from the day after the date of delivery. You must notify us in writing.
6.2 Please note that bespoke, custom-made, made-to-measure products, or those personalised to your specifications, cannot be canceled, refunded, or exchanged. Once we accept an order for such products, you do not have the right to cancel it as the Distance Selling Regulations do not apply to these items.
6.3 If you wish to return your goods it is your responsibility to take good care of the furniture and you are liable for any loss or damage. Failure to take reasonable care may result in a claim against you. To minimise the risk of any such claim we ask that you return the goods in appropriate packaging and take out insurance with the delivery company.
6.4 You are responsible for the cost of returning product to us (unless the item is faulty). Once we have received the item and are happy it has been returned in the same condition as it was dispatched, we will issue you with a full refund on the purchase price of the goods. If you are returning the products to us, please email contact@decur.co.uk or call or WhatsApp us on 03302233800 so we can best advise you regarding packaging ensuring the products returns safely.
Alternatively you can choose to accept a credit for the full price of the rug you ordered. This can be used towards the purchase of another item.
6.5 We will not refund any installation charges if applicable or charges made for specialist delivery.
6.6 Any furniture you order with additional options selected is custom made for you and as such once successfully delivered and signed for, the furniture may not be returned nor will we provide any refund unless it is defective or has been accidentally damaged by us in the course of delivery.
6.7 Following cancellation of your order any monies paid will be refunded by the method you used to pay and within 14 days.

7. Bespoke Feature Wall Headboards. How we work.
The way we work:
We can provide a price based on the size and height you require. We would then create an initial diagram / drawing based on your sizes and then email the order for you to make deposit of 50%.
We would complete a site visit and design consultation.
Once we've completed the site visit and design consultation we will update the drawing / diagram and order confirmation for you to confirm.
We would require 50% prior to the site visit and 50% when we start work. The 50% deposit is based on order value and the location of the customer. Please email if you have any further questions. contact@decur.co.uk
8. Custom, Bespoke & Made to measure:
Custom, bespoke and made to order products will be non-returnable and cannot be cancelled once the order has been placed. Please ensure that the measurements are correct and note the estimated delivery time shown on the site to allow for production.
Furniture products that have been made to order cannot be returned unless they are faulty. Our
Customer Service Team can inform you if the item you are buying is made to order, this made to order information is also available on the product category page, prior to clicking on the product and the product page under the description.
Fabrics
Cut fabrics that are cut specially to your requirements; and made to measure items unfortunately cannot be returned. We strongly recommend you order swatches prior purchasing fabric so that you can be sure that the fabric is the correct shade.
The minimum order for any fabric is 2 meters.
Trade:
Furniture products that have been made to order for trade / business orders cannot be returned. Our Customer Service Team can inform you if the item you are buying is made to order, this made to order information is also available on the product category page, prior to clicking on the product and the product page under the description.
Commercial grade furniture is made to an entirely different standard than regular furniture. Commercial grade furniture is only considered such once it successfully passes tests for durability, stability and weight bearing qualities.
Thus we will make adjustments and modifications of our products for commercial purposes where necessary. Commercial grade furniture undergoes extensive testing that other furniture sold to consumers.
Refunds:
Refunds on Goods cancelled prior to delivery will be made as soon as possible following written notification of cancellation and in any case will not exceed a period of 30 days of that written notice. All refunds will be made onto the same card used to make the original purchase. Cancelled order refunds, are processed within 72 hours
Refunds are subject to a 15% admin cancellation charge.
Refunds on Goods already delivered will take place as soon as possible following the collection, return and inspection of such goods and in any case will not exceed a period of 30 days following that collection/return. These refunds are subject to a 15% admin cancellation charge and an additional £30 delivery charge.
Please note, whilst every effort is made to accurately reproduce the appearance of furniture, upholstery etc. We cannot accept any responsibility for any colour misrepresentations: different colour display settings on computer monitors, phones and tablets can effect the appearance of colours of upholstery and furniture. The appearance of fabrics & leather colours and furniture can also vary in different lighting conditions: our photos were taken in good daylight conditions.
For instance, if three photographs are taken, of a fabric or leather in three different angles colours can very considerably: another example is when purchasing clothes off the internet, the colours can often look different when viewing in person.
We cannot accept returns for items on a basis of colour, and if your requirements are very particular in terms of your decor, please request a fabric swatch prior to buying the item.
All sizes given are approximate and the Buyer should check carefully that the goods will fit into the delivery address. The normal bed and mattress sizes (i.e. 3, 0" single 4'6" double and 5'0" king) refer to the sleeping surface only. The Buyer should check the overall dimensions of the furniture item or mattress given for each product, including depth.
Please be aware that mattress, rug and furniture sizes may vary slightly from their stated dimensions due to manufacturing tolerances.
All rugs are made to conform to BS3655.
Shedding is a natural characteristic of a deep pile rug and is not deemed to be a fault. This is common on Acrylic and Wool rugs and should be taken into consideration when choosing a product suitable rug for your home.
9. Our rights to cancel the contract
We may cancel the contract between us if:
* the goods you have ordered are unavailable for any reason;
* we do not deliver to your area; or
* one or more of the goods you ordered was listed at an incorrect price due to a typographical error or an error in the pricing information received by us from our suppliers.
If we do cancel your contract for either of these reasons we will notify you by e-mail and provide you with a full refund. We will not be obliged to offer any additional compensation for disappointment suffered.
d. Delivery of goods to you
We will deliver the goods ordered by you to the address you give us for delivery at the time you make your order.
Deliveries are usually 15 working days, but we ask that you allow up to 30 working days in the rare event that your item may be out of stock. Delivery times on custom made products will be displayed at the time of ordering. We will not be obliged to offer any additional compensation if the goods are not delivered within this time frame. You will be informed by email once your order has been dispatched, stating details of the courier used and the consignment note number. (Subject to the correct email address being entered when placing your order).
You will become the owner of the goods you have ordered when they have been delivered to you. Once goods have been delivered to you they will be held at your own risk and we will not be liable for their loss or destruction.
International deliveries are dispatched on a DDU basis (Delivery Duty Unpaid). This means the recipient should be liable for any local sales taxes, import duties and clearance fees which may be charged on the purchase. Sometimes goods may be subject to delays, due to customs or weather.
10. Our liability to you
a. Your remedy for damaged goods
In the unlikely event that the goods we deliver are not what you ordered or are damaged / defective, or the delivery is of an incorrect quantity, you must notify us within 7 days of receiving it.
We will then, at our option:
* make good any shortage or non-delivery; or
* replace any rug that following our inspection are damaged or defective; or
* refund the amount paid by you for the goods in question.
b. Limitations on our liability to you
You are responsible for observing and complying with all applicable regulations and legislation which affect your purchase and subsequent use of our goods. This includes obtaining all necessary customs, import or other permits to purchase goods from our site. Certain national laws may prohibit the importation or exportation of certain of our goods to you.
We make no representation and accept no liability in respect of the export or import of the goods you purchase.
To the extent that law permits us to do so, we exclude all our liability to you for any direct, indirect or consequential loss, damage or expenses (including loss of profits, business or goodwill) howsoever arising out of any problem relating to the goods you buy from us, other than the remedies listed in paragraph c above.
If a court does decide we are liable to pay you compensation, that compensation will be limited to the amount paid by you for the goods in question.
Please note that nothing in this section of these terms and conditions (or in any other section) is intended to limit any rights you might have as a consumer or other statutory rights that may not be excluded by law, nor in any way to exclude or limit our liability to you for any death or personal injury resulting from our negligence of for fraudulent misrepresentation.
11. Price Promise
In the unlikely event that you find the identical rug or furniture item cheaper on a competitors website we guarantee to beat the price by a further £5.00. We will require a copy of the link to the page where this is offered to validate the price promise. Please note we are unable to offer to beat prices offered on auction websites.
12. Things you should know
a. Events beyond our control
We shall have no liability to you for any failure to deliver goods you have ordered or any delay in doing so or for any damage or defect to goods delivered that is caused by any event or circumstance beyond our reasonable control including, without limitation, strikes, lock-outs and other industrial disputes, breakdown of systems or network access, flood, fire, explosion or accident.
b. Invalidity
If any part of these terms and conditions is unenforceable (including any provision in which we exclude our liability to you) the enforceability of any other part of these conditions will not be affected.
c. Privacy
You acknowledge and agree to be bound by the terms of our privacy policy.
We do not store credit card details nor do we share customer details with any 3rd parties.
d. Third party rights
A person who is not a party to this contract has no right under the UK Contracts (Rights of Third Parties) Act 1999 to enforce any term of this contract but this does not affect any right or remedy of a third party that exists or is available apart from that Act.
e. Governing law
The contract between us shall be governed by and interpreted in accordance with English law and the English courts shall have jurisdiction to resolve any disputes between us.
f. Entire agreement
These terms and conditions together with our terms of use and privacy policy, your order and our acceptance set out the whole of our agreement relating to the supply of the goods to you by us. Nothing said by any sales person on our behalf should be understood as a variation of these terms and conditions or as an authorised representation about the nature or quality of any goods offered for sale by us. Except for fraud or fraudulent misrepresentation, we shall have no liability for any such representation being untrue or misleading.
10. We charge £3000.00, if an image is used on a website without our consent.
13 Intellectual property in its entirety including content, software and images.
Decur owns or has approval to use the intellectual property rights and trademarks in its website and its content: such rights are protected globally and all the rights are reserved. We prohibit the use of our website content and trademarks being stored, printed or saved. We also prohibit the use of our website for commercial purposes unless we grant you permission. The Decur logo or brand cannot be used, replicated in accordance to our intellectual property rights.
Third Party Intellectual Property
13.1 Unless otherwise expressly indicated, all Intellectual Property rights including, but not limited to, Copyright and Trademarks, in product images and descriptions belong to the manufacturers or distributors of such products as may be applicable.
13.2 Misuse of our website:
It is a criminal offence to misuse or tamper with any information or data found on our website, apps, or services for instance attempt to hack, use; logic bombs, trojans, worms and other digital and technological malicious material or conduct detail of service attacks.
We prohibit the use of our technology, systems and functionality and taking our customers data. Any attempts to do so, will result in DECUR reporting you to the relevant authorities, and will press charges.
We prohibit the use of automated systems or software to extract data from our website i.e screen scraping or scraping for information.
We have a dedicated team who will monitor any suspicious activity across our services and are extra vigilant towards any attempts of intrusive behaviour. Our customers’ data is of utmost importance and we also encourage our customers to use anti-virus software to ensure they are safeguarded against such actions.
A caution to anyone ignoring these warnings; you agree to indemnify, defend and hold harmless DECUR, its directors, officers, employees, consultants, agents, and affiliates, from any, and all third-party claims, liability, damages and/or costs (including, but not limited to, legal fees) arising from your use (or misuse) of this website, or your breach of our Terms and Conditions.
Life time Guarantee:
16.1 This guarantee, outlined in clause 16.2, is supplementary to your statutory consumer rights and applies to all sofas bought from 1st April 2023 onwards. Please note, this guarantee is only valid for furniture located within mainland UK and does not extend to items used for rental or commercial purposes.
16.2 All upholstered items covered under a lifetime frame warranty.
- A) Seat and back cushions: These come with a 1-year guarantee from the delivery date.
- B) Fabric: Fabric faults reported within 1 year of purchase will be considered.
- C) Feet: Issues with feet will be addressed within 1 year of purchase.
To make a claim under this guarantee:
- (a) Proof of purchase is required.
- (b) We will either inspect the products on-site or arrange for their collection at our expense. If a genuine fault due to poor workmanship is found, we will either repair or replace the item. In the case of a replacement, you can choose an alternative product and pay any price difference.
16.3 This guarantee is non-transferable.
16.4 The guarantee excludes damage from normal wear and tear, neglect, abuse, misuse, water or weather exposure, fire, smoke, explosions, lightning, sunlight, infestation, theft, or accidental damage caused by third parties.
16.5 We are not responsible for any direct or indirect loss of profits or other financial loss or damage arising from defective, damaged, or wrongly delivered products, beyond the value of the products themselves. This does not affect your statutory rights.
16.6 This guarantee is valid only for upholstered products sold and kept in mainland UK for private and domestic use.
